Terms of Service
These Terms govern your use of cdpfleet, the remote browser service operated by Cdpfleet LLC ("cdpfleet", "we", "us"). By creating an account, using an API key or otherwise using the service, you agree to these Terms on behalf of the business you represent ("Customer", "you"). If you don't agree, don't use the service.
1. Business use only
cdpfleet is offered only to businesses and professionals acting for business purposes, not to consumers. By accepting these Terms you confirm that you're authorized to bind the business you represent.
2. The service
cdpfleet lets you start remote browser sessions through an API and control them over a WebSocket connection. Available browsers, versions, regions and features are described on cdpfleet.com and may change as browsers are updated. Features marked "early access" or "pre-launch" are provided for evaluation, may change or be withdrawn, and aren't covered by any availability commitment.
3. Accounts and API keys
- You're responsible for all activity under your account and API keys. Keep keys confidential and rotate them if you suspect exposure; tell us promptly about any unauthorized use.
- Keep your account contact details accurate.
- API keys are for your business. Don't share them with third parties or resell access to the service without our written consent.
4. Plans, threads and metering
- Your plan sets a number of threads: concurrent capacity for running browser sessions. Dedicated threads are reserved for you around the clock. Shared threads can each be used up to a set number of minutes per day (resetting at midnight UTC), with a maximum session length.
- Each session takes one or more threads depending on its type, as published on cdpfleet.com (for example, a headless Linux session takes 1 thread and a headful session takes 2).
- Usage is measured in thread-seconds, from the moment your session is ready until either side closes its connection. A session you never connect to ends automatically after about 60 seconds and is metered until then.
- When you reach a limit (threads, daily minutes, session length or request rate), new sessions are refused or running sessions end. That's the plan working as intended, not a service failure.
5. Fees and payment
- Fees are those shown for your plan when you subscribe, or agreed with us in writing. Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically until cancelled.
- Fees exclude taxes. You're responsible for all applicable taxes other than taxes on our income.
- Except where the law requires otherwise, fees are non-refundable, including for unused threads or minutes.
- We may suspend the service if payment is overdue, after notice to your account contact.
- We may change prices for future billing periods with at least 30 days' notice. The change applies from your next renewal, and you can cancel before then.
6. Acceptable use
You must use cdpfleet lawfully. You're responsible for your use of the service and for the websites, accounts and data your sessions access. You must not use cdpfleet, or let anyone else use it, to:
- break any applicable law, or infringe anyone's intellectual property, privacy or other rights;
- gain unauthorized access to accounts, systems or data, including credential stuffing, account takeover or brute-forcing logins;
- attack or overload any system, including denial-of-service attacks or deliberately excessive request volumes;
- send spam, run phishing, distribute malware, or commit fraud, including ad fraud and payment fraud;
- create, access or distribute child sexual abuse material or other illegal content;
- collect or process personal data unlawfully, including without a valid legal basis under data protection laws that apply to you;
- get around our limits, metering or billing, probe or attack our infrastructure, or interfere with other customers' use;
- connect proxies or other network resources you're not authorized to use.
We may investigate suspected violations and cooperate with law enforcement. We may immediately end sessions, suspend keys or suspend accounts where we reasonably believe these rules are being broken or the service or third parties are at risk. Where practical, we'll tell you why.
7. Your data
You keep all rights to the data your sessions process ("Customer Data"). You give us the limited right to host, transmit and process Customer Data only to provide the service. We don't inspect or store the content of your sessions beyond the connection metadata described in our Privacy Policy. Where Customer Data includes personal data, we process it as your processor, and a data processing agreement is available on request.
8. Availability and support
We work to keep cdpfleet available and performant, but unless we've agreed a service level in writing, the service is provided without an availability commitment. We may carry out maintenance and update browsers and infrastructure at any time. Individual sessions can end unexpectedly, and your code should be able to retry.
9. Intellectual property
We and our licensors own the service, its software and its documentation. Apart from the right to use the service under these Terms, you receive no rights in them. If you send us feedback, we may use it without restriction.
10. Disclaimer
To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, error-free, or suitable for accessing any particular website.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused. Each party's total liability arising out of or relating to these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. These limits don't apply to your payment obligations, your indemnity obligations, or liability that can't be limited by law.
12. Indemnity
You'll defend and indemnify us, and hold us harmless, against third-party claims, and the resulting losses, costs and reasonable legal fees, that arise from your use of the service, Customer Data, or your breach of these Terms or of applicable law.
13. Term and termination
These Terms apply while you use the service. You can stop using it and cancel your subscription at any time, and the cancellation takes effect at the end of the current billing period. We may terminate these Terms with 30 days' notice, or immediately if you materially breach them. After termination your access ends, and we delete account data as described in our Privacy Policy. Section 5 (for unpaid fees) and sections 7 and 9 to 15 survive termination.
14. Changes to these Terms
We may update these Terms. We'll post the new version on this page and, for material changes, email your account contact at least 30 days before they take effect. If you keep using the service after that, you accept the updated Terms.
15. General
- Governing law and venue. These Terms are governed by the laws of the United States and of the State in which Cdpfleet LLC is organized, without regard to conflict-of-law rules. The state and federal courts located in that State have exclusive jurisdiction, and both parties consent to it.
- Export and sanctions. You'll comply with applicable export control and sanctions laws, and won't use the service from, or for the benefit of, any sanctioned country or person.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Entire agreement. These Terms, your plan details and any written agreement signed by both parties are the entire agreement on this subject. If a provision is unenforceable, the rest stays in effect. Failing to enforce a provision isn't a waiver.
- Notices. We send notices to your account contact's email address. You can send notices to [email protected].
